Private Sale Record-Keeping:
10-Year Retention

Illinois requires every person who sells or transfers a firearm through a private transaction to retain a record of that sale for at least 10 years. This record-keeping obligation exists under the FOID Act (430 ILCS 65) and applies to every private transfer, whether between strangers, friends, or family members.[1]

What Records Must Be Kept

The private seller must document and retain the following information for each transfer:

  • The date of the transfer
  • The transferee's (buyer's) FOID card number
  • Identifying information sufficient to identify the buyer

While the statute does not prescribe a specific form or format, best practice is to record the buyer's full name, address, FOID card number, and the date and details of the firearm transferred (make, model, caliber, and serial number). The record should be kept in a durable format that can be produced if requested by law enforcement.[2]

FOID Card Verification Before Transfer

Before completing the transfer, the seller must verify that the buyer holds a valid, non-revoked FOID card. The ISP provides a free online verification portal at verify.ispfsb.com where sellers can confirm a buyer's FOID status. Since the Protect Illinois Communities Act took effect on July 1, 2023, this verification step has been reinforced as one of two mandatory methods for completing a lawful private transfer -- the other being processing the transfer through a licensed dealer.[3]

Why 10 Years

The 10-year retention period is one of the longest private sale record-keeping requirements in the nation. Most states that require private sale documentation mandate retention for three to five years, if they require it at all. Illinois's 10-year period reflects the legislature's view that firearm transfer records serve a critical role in law enforcement investigations, many of which involve tracing a weapon through multiple owners over extended periods. A 10-year window increases the likelihood that a record will still be available when investigators need to establish a chain of custody for a firearm used in a crime.[4]

Practical Considerations

The statute places the retention burden entirely on the seller. Unlike dealer sales, which are documented through the FTIP system and retained in ISP databases, private sale records exist only in whatever format the seller chooses to maintain. A handwritten note, a digital photograph of the buyer's FOID card, or a printed form all satisfy the requirement -- the law does not mandate a specific medium. Sellers should store records securely, as the obligation persists for a full decade regardless of whether the seller moves, changes contact information, or loses track of the buyer.

Penalties for Non-Compliance

Failure to maintain the required 10-year record can result in criminal charges. Transferring a firearm without verifying the buyer's FOID card is a separate and more serious offense. The record-keeping requirement and the FOID verification requirement are distinct obligations, and a seller who fails to comply with either one faces potential liability. Law enforcement may request production of private sale records during criminal investigations, and a seller's inability to produce them may be treated as evidence of non-compliance.[5]

Interaction with Universal Background Checks

The 10-year record-keeping obligation exists independently from the universal background check requirement introduced by the Protect Illinois Communities Act. Even when a private sale is processed through a licensed dealer (who maintains their own records under federal law), the private seller is still advised to retain their own documentation. The PICA amendments did not eliminate or modify the 10-year retention requirement under the FOID Act; they added a verification layer on top of it.[6]
