SB0008 / Public Act 104-0031: Safe Gun Storage Act
SB0008 / Public Act 104-0031: Safe Gun Storage Act
Senate Bill 0008, signed into law as Public Act 104-0031, establishes safe firearm storage requirements in Illinois, creating new obligations for gun owners to secure firearms from unauthorized access.
What the Bill Would Do
Public Act 104-0031 (originally SB0008) establishes statutory requirements for the safe storage of firearms in Illinois[1]. The law requires firearm owners to take reasonable steps to secure firearms from access by minors, prohibited persons, and individuals who pose a danger to themselves or others. Illinois already imposes criminal liability for allowing a minor to access a firearm under certain circumstances (720 ILCS 5/24-9), but this act broadens the storage mandate and specifies what constitutes adequate secure storage — including locked containers, trigger locks, and gun safes.
The act also directs the Illinois State Police (ISP) to develop a public education campaign about safe firearm storage practices and makes storage devices potentially tax-deductible under a companion provision.
Current Status
SB0008 was signed into law on July 28, 2025, as Public Act 104-0031[2]. The law is in effect.
What to Watch
Implementation details from ISP regarding the public education campaign are still forthcoming. Gun owners should review their current storage practices against the new statutory requirements. The law does not mandate the purchase of specific equipment but creates liability exposure for owners who fail to prevent access by prohibited individuals. The interplay with existing FOID Act (430 ILCS 65) provisions on household eligibility is a key area to monitor — if a household member is a prohibited person, the storage obligations become particularly stringent.
